These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and unstable.fi (“Platform,” “we,” “us,” or “our”) governing your access to and use of www.unstable.fi. By accessing, connecting to, or using the Website in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you are expressly prohibited from using the Website.

The Website is a non-custodial front-end interface that enables interaction with decentralized staking vaults powered by Kamino.com vault technology on the Solana blockchain. The Platform does not custody assets, does not control smart contracts, does not execute transactions on behalf of users, and does not have access to user private keys. All transactions are executed directly by users via their own blockchain wallets.

Yield is derived from trading volume of USDUC on PumpSwap and associated creator fees provided by PumpSwap. The availability, calculation, and continuation of yield depend entirely on third-party protocols and market activity. If PumpSwap ceases to provide creator fees for any reason, vaults will generate no APR. The Platform provides no guarantee, representation, or warranty regarding any APR, yield, or profitability. Yield may fluctuate or drop to zero at any time without notice.

You expressly acknowledge and assume all risks associated with decentralized finance participation, including but not limited to: smart contract vulnerabilities; protocol exploits; blockchain network failures; market volatility; liquidity shortages; regulatory changes; technological errors; total loss of principal; and permanent loss of access to digital assets. Deposits are not insured or guaranteed by any governmental authority or private insurer.

The Platform does not provide financial, investment, tax, or legal advice and does not owe any fiduciary duties to users. All information is provided for informational and interface purposes only. You are solely responsible for conducting independent due diligence and seeking professional advice.

By using the Website, you represent and warrant that you are at least eighteen (18) years of age and legally permitted to engage in cryptocurrency-related activities in your jurisdiction. You further represent that your use of the Platform does not violate any applicable laws or regulations. You bear sole responsibility for legal compliance.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM, ITS OPERATORS, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR ANY THIRD-PARTY PROTOCOL.

You agree to indemnify, defend, and hold harmless unstable.fi and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Website, violation of these Terms, or violation of applicable law.

THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. THE PLATFORM DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We reserve the right to modify, suspend, or discontinue the Website or these Terms at any time without notice. Continued use following modifications constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable international legal principles. Any disputes arising from or relating to these Terms shall be resolved exclusively through binding arbitration, and you waive any right to participate in class actions or jury trials.
